What is important:
Employment contract: If the employment contract stipulates certain penalties or conditions for withholding money from wages for lateness, the employer can apply it.
Legal limit: According to the Labor Code of the Republic of Azerbaijan, the employer has the right to withhold a certain part of the salary as a penalty only on legal grounds and for a certain period of time. Withholding the full salary is illegal.
Reason for the delay: If the delay occurred through no fault of the employee (for example, traffic problems, illness, etc.), it is not correct to apply a penalty.
Agreements and rules: The company’s internal regulations, work rules and permitted lateness limits should also be taken into account.
💡 In short: The manager can withhold money from wages, but only in cases that are legal and specified in the contract. Otherwise, this is not considered correct.
